After a judge ruled he didn’t live in the district, a Democratic-Farmer-Labor legislative candidate won’t take the seat he won in the November election. The move will grant Minnesota Republicans at least a temporary majority in the House when the Legislature convenes on Jan. 14.

Republicans gain one-seat majority heading into 2025 session as a DFL-won seat becomes vacant. A special election will come early next year.

A DFL state representative-elect said Friday he will not appeal a judge's ruling that he is ineligible to hold the office because he did not meet residency requirements​ for the district.

The ruling also means the Minnesota House is currently in GOP control with a 67-66 lead. “A prompt special election will allow the voters of District 40B to ensure that they wil
